OUR TERMS:
This agreement contains the entire understanding between Nicki Hufford Photography and the TEAM/ORGANIZATION. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. In the event that the parties waive a portion of this agreement, the contract is not waived in its entirety. The party against whom a waiver is sought to be effective must have the waiver in writing.

The parties agree to work collaboratively and communicate effectively to achieve the objectives of this agreement
2. COST
Why We Have a Booking Fee:
To ensure we can provide the exceptional service and high-quality products we're known for, we have a $10 booking fee per athlete. This fee helps us cover the costs of:
- FREE Team Banners: A custom banner for every team to display their pride.
- Efficient Scheduling and Communication: Seamless organization and timely support.
This small investment allows us to deliver a truly valuable and hassle-free experience for your team.
3. ATTENDANCE AND ILLNESS POLICY
Team Photo Participation:
While we use compositing techniques to create the team photo, we strive for a traditional feel. This means that all athletes present during the scheduled photo session will be included in the team image. To ensure everyone is included, please:
- Communicate Clearly: Emphasize to parents the importance of attending the scheduled session.
- No Make-Up Days: We cannot offer make-up sessions for missed appointments.
- No Refunds for No-Shows: Please note that no refunds will be issued for athletes who miss their scheduled photo time.
Team Photo Attendance is Key:
We strive to accommodate everyone, but it's crucial for all athletes to attend the scheduled team photo day. This ensures a complete team picture and timely delivery of your gallery and products.
Important Considerations:
- Plan Ahead: Contact us immediately if you foresee a conflict.
- Individual Session Fee: A $50 fee applies for individual make-up sessions outside of regular team photo days.
Unexpected Illness? We Understand.
We know that illnesses can happen unexpectedly. If your athlete is unable to attend the scheduled team photo day due to a sudden illness, please contact us within 24 hours to reschedule.
Make-Up Session Details:
- Studio Session: The make-up session will be held at our studio in Cortland, Ohio.
- Timeframe: The athlete must be photographed within 3 days of the original team photo day.
- Scheduling: Make-up sessions are subject to availability and must be scheduled during our regular business hours (Monday-Thursday, 9:00 AM - 5:00 PM).
We will do our best to accommodate your needs while ensuring we can deliver your team's photos promptly.
4. COPYRIGHTS & EXHIBITION:
The photographs produced by Nicki Hufford Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without NHP's explicit written permission. It is a breach of this agreement to reproduce the images in any form without explicit written permission.
Requests for photographic images to be used by Nicki Hufford Photography may be requested at a future time. TEAM/ORGANIZATION grants Nicki Hufford Photography permission to display selected images resulting from this assignment as an example of Nicki Hufford Photography’s work and for entrance into photographic competitions and release all claims to profits that may arise from the use of images.
If TEAM/ORGANIZATION's photo is requested to be used in any print or online publication, they will discuss this with Nicki Hufford Photography. NHP grants TEAM/ORGANIZATION limited rights to use the images in marketing materials with specifications that a photo by NHP is listed on the image/article. If TEAM/ORGANIZATION requests to use the image in the distribution of products such as but are not limited to posters, clothing, etc., a 15% compensation rate of the total number of sales will apply unless otherwise agreed upon in writing. ***Please note, NHP can offer most of these items at discounted rates.
5. Limit of Liability: NHP takes the utmost care with respect to exposure, transportation, and processing of the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond NHP’s control, Nicki Hufford Photography's liability is limited to the return of all payments received for the product packages ordered by each parent. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of a total number of originals.
6. Social Media Policy: You are free to share any of your team photo on any personal and business social media platforms. Any photos shared that have been altered by “filters” or creative cropping will be a direct conflict with this contract: and must be removed immediately.
7. Extensive Editing Policy: It is standard that the sports photos be edited, and provided to the TEAM/ORGANIZATION in our agreed-upon timeline. In the event that the TEAM/ORGANIZATION/PARENT requests more extensive editing: Editing can be provided for a fee of $50, to be paid prior to any additional editing being completed.
8. Cancellation and Rescheduling Policy: If the TEAM/ORGANIZATION must cancel, NHP must be notified at info@nickihuffordphotography.com 30 days prior to the date to qualify for a reschedule. The rescheduled date will be made as soon as possible, at the photographer’s discretion. All reschedules will be NHP's Studio. NO REFUNDS WILL BE GIVEN TO PARENTS WHO DO NOT SHOW OR IF A TEAM/ORGANIZATION CANCELS.
9. Props: The TEAM/ORGANIZATION is responsible for bringing sports equipment that is needed for the sports photos.
10. Location Access and Fees: If the TEAM/ORGANIZATION chooses a location that charges admission, an access fee, a parking fee, or a photography fee, the TEAM/ORGANIZATION will be responsible to cover those fees associated with shooting at those locations. The TEAM/ORGANIZATION also be responsible for organizing the access and any permits related to doing so.
11. Tardiness: In the event that the team or any player is late to the appointed time and there is not enough time before the next team, that team or player will have to wait until the next available time slot.
12. Completion Schedule: Editing and image delivery takes approximately 2-3 weeks, but may take longer (for example - the athlete is sick and we have to wait to complete orders). In the event that image delivery is outside of this time, the TEAM/ORGANIZATION will be notified via email before the due date.
